MYCOURIR PLUS LOYALTY PROGRAMME

The "myCOURIR plus" Loyalty programme (hereinafter referred to as the "Loyalty Programme") is developed by GROUPE COURIR, a Société par Actions Simplifiée (simplified joint stock company) with a share capital of 65 675 047,95 euros, registered in the Paris Trade and Companies Register under no. 843 726 704, whose registered office is located at 91 avenue Ledru Rollin, 75011 Paris. This Loyalty Programme is valid in all "COURIR" shops in mainland France and Corsica, as well as on the website www.courir.com.

1. JOINING THE LOYALTY PROGRAMME

The cost of joining the “myCOURIR plus” aspect of the Loyalty Programme is €9 including VAT (nine euros including VAT).

To join the “myCOURIR plus” aspect of the Loyalty Programme, simply provide your details (surname, first name, email address, mobile phone number and date of birth) at the checkout in COURIR shops located in mainland France and Corsica, or fill in these same details when you create an account on the www.courir.com website or fill in the same details on the form available by scanning the QR Code displayed in shop.

Participation in the Loyalty Programme is subject to the express and unreserved acceptance of the membership conditions and implies that the customer is aware of the conditions of the Programme. Any potential member who disputes all or part of the conditions of membership of the Loyalty Programme will be refused access to it. Membership is individual, nominative and strictly personal, and only the member may benefit from the advantages described below. Courir reserves the right to delete duplicates and, in the event of fraud or commercial intent, to block the customer in the event of multiple memberships or suspicion of accumulation of loyalty programmes. This Loyalty Programme is only available to individual customers. The signature of the legal representative or legal guardian will be required for individuals under 15 (fifteen) years of age or for incapacitated adults.

The cost of membership of myCOURIR of above €9 including VAT (nine euros including VAT) is not refundable.
However, in case of subscription on the website, the member has a period of 14 (fourteen) days from the date of purchase to withdraw. If the member exercises his/her right to withdraw, Courir will reimburse the cost of membership and the member will lose the points accumulated and benefits associated with the Loyalty Program without being able to exercise any recourse against this loss.

2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF MEMBERSHIP

The member acknowledges having read and accepted these general terms and conditions of membership by joining MyCourir plus.

In the event of non-compliance with the conditions of the myCOURIR Programme or suspicion of fraudulent use of the said Programme the member acknowledges that they are exposed to the risk of their account and all associated customer accounts being deleted.

3. BENEFITS OF THE LOYALTY PROGRAMME

3.1 Points accumulated: all purchases on the website www.courir.com or in shop (excluding outlet shops) with the myCOURIR plus card entitles you to points. Each purchase of 1 (one) euro entitles you to 1 (one) point. This excludes the purchase of gift cards and the use of tier discounts. Earned points are held in escrow for 7 (seven) days and can only be used after this period. When a purchase is returned, the points credited at the time of purchase are lost. Points and associated discounts are valid for 24 (twenty-four) months from the date of acquisition. At the end of this period, Courir France reserves the right not to retain the points acquired by the member if they have not been used. Points cannot be exchanged for any other means of payment and are non-transferable.

Points cannot be credited if the loyalty number or the member's name is not given at the time of purchase.

Points can be accumulated up to a maximum of 1199 (one thousand one hundred and ninety-nine) points. In addition, points can only be accumulated on 2 (two) receipts per day and 4 (four) per week. Purchases will not count towards points beyond these limits. Similarly, once the 1199 (one thousand one hundred and ninety-nine) ceiling has been reached, any purchases made will no longer give entitlement to any points or benefits in any form whatsoever. Members must first use their already accumulated points to continue earning points.

It is recalled that any point not used during a period of twenty-four (24) months is automatically cancelled and may not give rise to any benefit or consideration of any kind whatsoever.

The courir.com account used to make purchases must have the same email address as the myCOURIR account in order that points can be accumulated. Members of the Loyalty Programme may check the total number of points they have accumulated at any time in the “my account” section of the www.courir.com website. Membership of the Loyalty Programme does not constitute access to a means of payment.

3.2 Once a customer has joined the Loyalty Programme (and provided they have agreed to be contacted about the latter) they will receive a welcome offer of 10% (ten percent) by email or text message to be used on their next purchase. This offer is valid for 3 (three) months following its issue and can be used only once upon presentation of the identity card. This is valid excluding sales, promotions, batch sales and the purchase of Courir gift cards, gift packaging, myCOURIR loyalty cards, Partner Programme products and products excluded from promotional offers and codes see the list here. It is non-refundable, may not be subdivided, is non-cumulative, and no change will be given.

3.3 Birthday Offer. A €10 (ten euros including VAT) voucher is sent by e-mail to the member, subject to having accepted to be solicited for the Loyalty Programme, 15 (fifteen) days before the date of his/her birthday. The voucher is valid for a total of 1 (one) month. It can only be used once on presentation of the identity card and the voucher. It is valid for all product purchases of at least 11 (eleven) euros, excluding sales, promotions, batch sales and purchases of Courir gift cards, excluding products from the Partner Programme, excluding products excluded from offers and promotional codes, see the list here. It is non-refundable, non-splittable, non-cumulative and no change will be given. A reminder text message will also be sent to members to remind them of the voucher's availability.

3.4 Loyalty discounts:

3.4.1 From 200 (two hundred) points, the member receives a discount of 10% (ten percent) on their next purchase up to a maximum of three items (offer cannot be combined) and according to these conditions:

• Excluding sales, promotions and batch sales
• Excluding purchase of Courir gift cards
• Excluding Partner Programme products
• Excluding products excluded from promotional offers and codes
• Gift wrapping, myCOURIR loyalty card excluded from loyalty discounts

They will have the choice of using it - which will debit their account with 200 (two hundred) points - or continuing to collect points, with the balance remaining on their account and being added to subsequent points. Using this discount does not earn points for the purchase.

3.4.2 From 400 (four hundred) points onwards, members will receive a 25% (twenty-five percent) discount on their next purchase up to a maximum of three items (offer cannot be combined) and subject to the following conditions:

• Excluding sales, promotions and batch sales
• Excluding purchase of Courir gift cards
• Excluding Partner Programme products
• Excluding products excluded from promotional offers and codes
• Gift wrapping, myCOURIR Loyalty card excluded from loyalty discounts

They will have the choice of using it - which will debit their account with 400 (four hundred) points - or continuing to collect points, with the balance remaining on their account and being added to subsequent points. Using this discount does not earn points for the purchase

3.4.3 From 600 (six hundred) points, the member will receive a 40% (forty percent) discount on their next purchase up to a maximum of three items (offer cannot be combined) and subject to the following conditions:

• Excluding sales, promotions and batch sales
• Excluding purchase of Courir gift cards
• Excluding Partner Programme products
• Excluding products excluded from promotional offers and codes
• Gift wrapping, myCOURIR loyalty card excluded from loyalty discounts

They will have the choice of using it whenever they wish, and their account will then be debited with 600 (six hundred) points. Using this discount does not earn points for the purchase.

3.5 Bonus points.

• 100 (one hundred) bonus points to move from myCOURIR start to myCOURIR plus Programme if more than €100 (one hundred euros including VAT) is spent in the last 12 (twelve) months,
• 20 (twenty) bonus points on the loyalty card added to the Wallet after joining. This bonus is valid only once per loyalty card.
• 20 (twenty) bonus points if you sponsor someone a maximum of 4 (four) times a year + 10 (ten)% for your sponsored friend when they join myCOURIR plus,
• 20 (twenty) points if you return your sneakers to be recycled to shops participating in the "Recycle your ex sneakers" operation a maximum of 2 (two) times a year,
• 20 (twenty) points if you choose Click & Collect delivery instead of home delivery if the latter was free when you placed your order,
• 20 (twenty) points for every purchase of a Green Spirit product,
• 20 (twenty) points if you complete Courir questionnaires (up to a limit of 2 (two) times a year).

3.6 Miscellaneous.

From 100 (one hundred) points, customers can decide to make a donation of €3 (three euros) to a partner association

From 200 (two hundred) points, customers can choose free home delivery when placing their order.

3.7 myFAMILY PROGRAMME

• 20 (twenty) points per new member, a maximum of 5 (five) times on a customer's account.
• As part of the myFAMILY Programme, you will receive €5 (five euros) free from a purchase of €6 (six euros), 1 (one) month before the birthday of one of the members, valid for 1 (one) month. The customer may not receive more than 5 (five) vouchers per year.

These discounts will be deducted from the purchase price, whatever their value.

You will be asked to show proof of identity when you use your loyalty discount in shop.

Loyalty discounts may be used 3 (three) times per calendar year for each of the above-mentioned tiers.

In the event of an exchange or refund, the customer will be reimbursed the amount paid at the time of purchase, i.e. the amount paid after deduction of the loyalty benefit. In the event of the exchange or refund of products purchased with a welcome voucher, anniversary voucher or loyalty discount, the customer will not be able to recover the offer used or the points consumed.

3.8 COURIR may implement specific actions aimed at some or all of the members of the Loyalty Programme. These actions will be defined and announced by any means deemed appropriate (shop displays, letters, e-mails, etc.).

4. DURATION OF THE MEMBERSHIP

The membership has no expiry date. However, in order to meet the requirements of the General Data Protection Regulation, Courir is obliged to anonymise the data of any person who has not had any contact with the company over the last 5 (five) years. Anonymisation means that membership is inactivated and therefore no longer valid.

5. RETURN

Article L221-18 of the Consumer Code provides for a 14 (fourteen) day withdrawal period for distance sales. As part of the myCOURIR Loyalty Programme, our customers can benefit from a 30 (thirty) day return or exchange period on the website and in-store.

The rest of the provisions set out in the general terms and conditions of sale in the “returns” article remain unchanged.

6. LOSS OR THEFT

In the event of loss and/or theft of the old myCOURIR loyalty card, the member must notify Courir Customer Services as soon as possible at 09 70 25 22 39 (cost of a local call), via the following contact form: https://www.courir.com/fr/contact or by email to serviceclients@courir.fr.

The account will be cancelled and replaced by a new one. The acquired benefits will not be lost as a result of this replacement.

7. CHANGE OF ADDRESS

Any change in the member's contact details or name must be reported to Customer Services using the following contact form https://www.courir.com/fr/contactor by email to serviceclients@courir.fr or on 09 70 25 22 39.

The member guarantees the accuracy of all information provided and will be solely responsible for any erroneous, incomplete or obsolete information.

8. FRAUDULENT USE OF THE CARD

Any breach of these general terms and conditions of membership and any fraudulent use by the member or any third party acting on behalf of the member will automatically lead to the deactivation of the loyalty account. In the event of proof of fraudulent or abusive acquisition of points or in the case of breach of these general terms and conditions of membership, these will be cancelled without compensation (after verification).

COURIR reserves the right to carry out checks on compliance with the general terms and conditions of use of the MyCourir Plus Loyalty Programme. COURIR reserves the right to refuse or cancel an order and to deactivate the member's loyalty account without compensation if it considers that the member is using the benefits of their membership to engage in distribution or to carry out an economic activity using the products thus purchased or ordered.

9. BOTS

The use of computer bots to make a purchase on the courir.com website is strictly prohibited and constitutes fraudulent use of the myCOURIR Plus card.

A computer bot is a script, Programme or software which performs multiple, automated, repetitive and predefined tasks with the aim of buying faster than human users.

Similarly, any attempt to electronically manipulate the following elements:

• change IP address (using residential proxy);
• modification of the user-agent or browser fingerprint;
• automatic captcha resolution;
• handling HTTP requests
is considered fraudulent. This list is not exhaustive.

10. MODIFICATION OR TERMINATION OF THE LOYALTY PROGRAMME

COURIR reserves the right to modify these general terms and conditions of membership at any time without having to justify its decision. COURIR undertakes to inform members by any means it deems appropriate in the event of modification.

11. PROTECTION OF YOUR PERSONAL DATA

By subscribing to myCOURIR plus, you agree to receive certain communications necessary for the performance of the service, such as important notifications relating to your membership (changes to the loyalty programme, closure of your local shop). These communications are distinct from promotional emails.

12. APPLICABLE LAW

This Loyalty Programme and its general terms and conditions of membership are governed by French law.

13. MEDIATION

The Order of 20 August 2015 and Decree no. 2015-1382 of 30 October 2015 on mediation in consumer disputes, implementing Directive 2013/11/EU of the European Parliament of 21 May 2013 on the out-of-court settlement of consumer disputes, give consumers the option of referring to mediation in order to facilitate the amicable settlement of disputes with a professional in connection with a sale made from the courir.com website.

Thus, for any dispute which has not been settled directly with the Company, the Customer is informed that they may now have free recourse to the mediation service set up by “Médiation - Vivons mieux ensemble.”

11. APPLICABLE LAW

This Loyalty Programme and its general terms and conditions of membership are governed by French law.
